Terms of Service - BrainStorm

1. Introduction

These Terms of Service ("Terms") govern your purchase and use of digital products ("Products") offered by Warmer Sun Education ("We," "Us," or "Our") through the BrainStorm platform. By purchasing, downloading, or using our Products, you ("Customer," "You," or "Your") agree to these Terms and our Privacy Policy.

2. Product Purchases

BrainStorm offers digital PDFs for individual purchase. No subscription is required. Upon payment, you receive a license to download and use the purchased PDF(s) for personal and limited sharing purposes as outlined below.

3. Personalized Stamping

Each purchased PDF will be stamped with the Customer's email address or other identifying information. This watermark is used to discourage unauthorized distribution.

4. Permitted Use

Customers may:

Download and store the PDF for personal use.
Share the PDF privately with friends and family.

Customers may not:

Upload or distribute the PDF publicly online (e.g., websites, forums, social media).
Sell, resell, or commercially distribute the PDF.
Remove, obscure, or alter the identifying watermark.

5. Payment and Delivery

All payments are processed securely through our designated payment provider. Upon successful payment, a link to download the Product will be provided. It is the Customer’s responsibility to ensure that the email address entered at checkout is accurate for delivery purposes.

6. Refund Policy

Due to the nature of digital goods, all sales are final. We do not offer refunds or exchanges once a Product has been delivered, except where required by law.

7. Intellectual Property

All Products, including but not limited to the PDFs and their content, remain the intellectual property of Warmer Sun Education. Purchasing a Product grants you a limited, non-exclusive, non-transferable license to use the Product as permitted under these Terms.

8. Limitation of Liability

Warmer Sun Education is not liable for any damages arising from the use or inability to use our Products, beyond the amount paid for the Product.

9. Changes to Terms

We reserve the right to update these Terms at any time. Any changes will be posted on our website, and continued use of our Products after changes are posted constitutes acceptance of the new Terms.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
